By using MsgCrypt, you agree to these terms. If you do not agree, please do not use the service.

1. Agreement to terms
These Terms of Service govern your use of MsgCrypt (the “Service”) operated by Downriver IT. By accessing or using the Service, you agree to be bound by these terms.
2. Description of the service
MsgCrypt provides client-side encrypted messages and shortlinks with configurable view limits, expiration, and activity reporting. Some features require an account or a paid plan.
3. User accounts
If you create an account, you agree to provide accurate information, maintain the security of your credentials, and accept responsibility for activity under your account.
4. Acceptable use
You agree not to use the Service to violate laws, infringe on the rights of others, distribute harmful content, or attempt unauthorized access. We may suspend or terminate access for violations or suspected abuse.
5. Encryption and message access
Messages and files are encrypted in your browser. We do not store encryption slugs or plaintext content. If a slug is lost, content cannot be recovered.
6. Analytics and activity metadata
When a recipient opens a message or shortlink, we collect access metadata (such as IP address, approximate location, device/browser details, and timestamps) to provide activity reporting and protect against abuse. This metadata is visible to the sender in their dashboard.
7. Retention and deletion
Messages and shortlinks are retained according to plan limits and self-destruct settings. Expired content may be purged and cannot be restored.
8. Payment terms
Paid features are billed according to your selected plan. Unless otherwise stated, fees are non-refundable. Late or failed payments may result in downgraded access or service suspension.
9. Intellectual property
The Service, including its content and functionality, is owned by Downriver IT and protected by applicable laws. You may not copy, modify, or distribute our materials without written permission.
10. Disclaimer of warranties
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
11. Limitation of liability
To the fullest extent permitted by law, Downriver IT is not liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Downriver IT from claims arising from your use of the Service or violation of these terms.
13. Termination
We may suspend or terminate access to the Service at any time for violations of these terms or to protect the platform and users.
14. Changes to terms
We may update these terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
15. Governing law
These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
